03. Refund Policy

1. Scope
This Refund Policy applies to all services provided by LumivantaGroup, located at Calle Federica Montseny 11, 1, Piso 2, Fuenlabrada, Madrid, Spain, including web development, design, and consulting services.
2. Project Milestones and Payments
Our services are typically structured around project milestones with corresponding payment schedules. Refund eligibility is assessed based on the project stage at the time of the refund request:
- Before Project Commencement: Full refund minus any administrative fees (up to 10% of the total project value)
- During Discovery/Planning Phase: Up to 50% refund of payments made, depending on work completed
- During Development Phase: Refund calculated proportionally based on completed vs. remaining milestones
- After Project Completion: No refund available unless the delivered work fails to meet the agreed specifications
3. Requesting a Refund
To request a refund, you must contact us at [email protected] within 14 days of the payment date. Please include your project reference number and the reason for your refund request. We will respond to your request within 5 business days.
4. Non-Refundable Items
The following are non-refundable: domain registration fees, third-party software licenses, hosting fees already incurred, and any work delivered and approved by the client.
5. EU Consumer Rights
Nothing in this policy affects your statutory rights under EU consumer protection law, including the right to a refund for services that do not conform to the agreed specifications or applicable quality standards.
04. Terms of Service

1. Acceptance of Terms
By accessing and using the services of LumivantaGroup, located at Calle Federica Montseny 11, 1, Piso 2, Fuenlabrada, Madrid, Spain, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services Description
LumivantaGroup provides web development, design, and consulting services specializing in accessible, WCAG-compliant digital experiences. The scope, deliverables, and timeline for each project will be defined in a separate Statement of Work (SOW) or service agreement.
3. Client Obligations
The client agrees to:
- Provide timely access to necessary resources, content, and information
- Designate a primary point of contact for project communications
- Review and approve deliverables within agreed timeframes
- Make payments according to the agreed schedule
- Ensure that all content provided does not infringe third-party intellectual property rights
4. Intellectual Property
Upon full payment, the client receives ownership of all custom-developed code, designs, and content created specifically for their project. LumivantaGroup retains ownership of pre-existing tools, frameworks, and methodologies used in the development process.
5. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information exchanged during the course of the project. This obligation survives the termination of the service agreement for a period of two years.
6. Limitation of Liability
LumivantaGroup's total liability shall not exceed the total fees paid by the client for the specific service giving rise to the claim. We shall not be liable for indirect, incidental, or consequential damages.
7. Termination
Either party may terminate the agreement with 30 days' written notice. In the event of termination, the client shall pay for all work completed up to the termination date.
8. Governing Law
These terms are governed by the laws of Spain and the European Union. Any disputes shall be resolved in the courts of Madrid, Spain.
